102 IN THE HIGH COURT OF PUNJAB AND HARYANA CHANDIGARH CRM-M-47117-2025(O&M) Date of Decision: 27.08.2025 MANPREET KAUR …Petitioner V/S STATE OF PUNJAB …Respondent CORAM: HON’BLE MS. JUSTICE SHALINI SINGH NAGPAL Present: Mr. Tarun Singla, Advocate for the petitioner. Mr. Hardeep Singh Wadhwa, DAG Punjab. **** SHALINI SINGH NAGPAL J. (Oral) Petitioner seeks anticipatory bail in case arising out of FIR No. 113 dated 02.08.2025 under Sections 85 of Bharatiya Nyaya Sanhita, 2023 (offence under Section 80 BNS added later on) Police Station Doraha, District Khanna. This is her first petition for anticipatory bail. Learned counsel for the petitioner submits that petitioner was married sister-in-law of deceased, who poured oil on herself and set herself ablaze. He further argued that there was no allegation of demand of dowry, either against the husband or against the sister-in-law; that it was second marriage for both the deceased and her husband. Learned counsel further urged that petitioner was residing separately with her husband Birender Singh, who she married in 2021 and had a one year old child from him. In fact, petitioner never interfered in her parental family affairs nor, deceased ever moved any complaint to the police regarding her harassment, prior to registration of FIR. There was 39 hours delay in lodging of the FIR. Referring to Annexure P-3, he submitted that FIR AJAY GOSWAMI 2025.08.29 16:19 I attest to the accuracy and integrity of this document CRM-M-47117-2025(O&M) -2- was got registered against the in-laws of deceased from the first marriage as well. He submitted that petitioner was ready and willing to join investigation. Therefore, she be enlarged on anticipatory bail. Notice of motion. Learned State counsel accepts notice on behalf of respondent State and strongly opposes the prayer for grant of anticipatory bail on the ground that allegations against the petitioner were specific, serious and on account of the physical and mental cruelty inflicted, deceased was led to commit suicide. Deceased Kulwant Kaur wife of Ravinder Singh, who was admitted in Dayanand Medical College and Hospital Ludhiana, made statement to the police that she was married with Ravinder Singh son of Rachhpal Singh resident of village Jahangir, Tehsil Payal, District Ludhiana. It was second marriage for both of them. Her sisters-in-law Harpreet Kaur wife of Gurpreet Singh, resident of village Mannvi, District Malerkotla and Manpreet Kaur wife of Vicky resident of village Rohno Kalan, Police Station Sadar Khanna, District Ludhiana, taunted her with regard to household work. Her elder sister-in-law Harpreet Kaur unduly interferred in her in-laws family. Both her sisters-in-law detained her in a room and gave her beatings. They used to provoke her husband, due to which Ravinder Singh thrashed and abused her, after returning from duty. He did not allow her to operate mobile phone and taunted her for using mobile. Her sisters-in-law and her husband caused her mental torture. In the intervening night of 30-31/07/2025, her husband thrashed AJAY GOSWAMI 2025.08.29 16:19 I attest to the accuracy and integrity of this document CRM-M-47117-2025(O&M) -3- her. Fed up with the beatings given by Harpreet Kaur, Manpreet Kaur and her husband-Ravinder and due to mental torture, she poured oil on herself and set herself ablaze on 01.08.2025 at about 8.45 AM. Case is at initial stage. Allegations are very serious. Considering the nature and substance of allegations against the petitioner, there are no extraordinary circumstances made out for grant of concession of anticipatory bail. Therefore, without commenting on the merits of the case, the petition stands dismissed.
