JUSTICE SHAILENDRA SINGH ORAL ORDER 2 23-09-2025 The instant case (writ application) has been filed by the petitioner under Article 226 of the Constitution of India, seeking Patna High Court CWJC No.15038 of 2025(2) dt.23-09-2025 2/3 the following relief(s): “ (A) A Writ of Certiorari setting aside quashing of the Bhoodan Danpatra no. 765702 as well as 765703 (Annexure P 2) issued by Bihar Bhoodan Yagna Committee Corresponding Land in question i.e CS Khata no 156 CS Khesra no 972 Area (14 dicimal)RS Khata no 1939 RS Keshra no 3480 Area 14 dicimal Muaza Gajhara Thana no 152 Circle Ladaniya Subdivision Jainagar District Madhubani Bihar in Revisional survey Khatiyan as Gairmazarua Land (GM Land) vested in Government of Bihar and previous Cadastral Survey Khatiyan its also Gair Mazrua Am Land. (B) A Mandamus Commanding the respondent authorities to take appropriate step(s) for early disposal of petition dated 18.06.2025 (Annexure P 3) which is pending before respondent no 10 The Chairman Bhoodan Land Distribution Enquiry Commission, Revenue and Land Reforms Department Government of Bihar for adjudication of land in question CS Khata no 156 CS Khesra no 972 Area (14 dicimal )RS Khata no 1939 RS Keshra no 3480 Area 14 dicimal Muaza Gajhara Thana no 152 Circle Ladaniya Subdivision Jainagar District Madhubani Bihar in Revisional survey Khatiyan as Gairmazarua Land (GM Land) vested in Government of Bihar and previous Cadastral Survey Khatiyan its also Gair Mazrua Am. (C) For any other relief/ reliefs for which the petitioner is found entitled to in the facts and circumstances of the present case.” 2. Heard Mr. Manish Kumar No 13, learned counsel for the petitioner and Mr. Subodh Kumar, learned AC to SC-26 appearing for the State-Respondents. 3. The main grievance of the petitioner is that Bhoodan Danpatra Nos. 765702 and 765703, issued by the Patna High Court CWJC No.15038 of 2025(2) dt.23-09-2025 3/3 Bhoodan Yagna Committee to the father/ancestor of private Respondent Nos. 11 to 14, are completely illegal and forged, furthermore, the petitioner’s right to easement is being affected by the private respondents. 4. To redress the aforesaid issues, the petitioner has already filed a case/representation (Annexure-P/3) before Respondent No.10, the Chairman, Bhoodan Land Distribution Enquiry Commission, Revenue and Land Reforms Department, Government of Bihar, a few months ago, which is still pending. This Court is not persuaded to invoke its writ jurisdiction to redress the petitioner’s issue at this stage. Accordingly, the instant writ petition stands disposed of, with a liberty to the petitioner to pursue his aforesaid case/representation filed before Respondent No.10, the Chairman, Bhoodan Land Distribution Enquiry Commission, Revenue and Land Reforms Department, Government of Bihar. 5.
