LPA No. 327/2024 Page 1 of 2 Sr. No. 1 Regular Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR LPA No. 327/2024 Fayaz Ahmad Shah …Petitioner(s)/Appellant(s) Through: Mr. Ateeb Kanth, Adv. Vs. Managing Director Hotel Grand Mumtaz ...Respondent(s) Through: Mr. Nissar Ahmad Bhat, Adv. CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE PUNEET GUPTA, JUDGE O R D E R 10.02.2025 The petitioner is aggrieved and has called in question an interlocutory order dated 18th September 2024 passed by the learned Single Judge of this Court (Writ Court) in OWP No. 2191/2015, whereby the application seeking amendment of the writ petition filed by the respondent, has been allowed. Learned counsel for the petitioner submits that the impugned order does not spell out the reasons for allowing the amendment which was sought by the respondent after lapse of more than seven years of the filing of the petition. He, however, fairly submits that in the amended petition, the respondent has not put up any special case which is required to be rebutted. He, however, submits that allowing of the application for amendment, that too, by an unreasoned order has only prolonged the litigation. Having heard learned counsel for the parties and perused the record, we are of the considered opinion that the order impugned does not suffer from any legal infirmity and, therefore, does not call for any interference by us. Learned counsel for the appellant, however, fairly submits that he does not want to file any reply to the amended petition, but prays that the Writ Court may be requested to expedite the hearing so that the petition is finally disposed of. The parties do not wish to file any pleadings. The appeal is dismissed. Let the writ petition come up for final consideration on 17th February 2025.
