02/25.04.2025 Heard the Parties.
Petitioner has been made an accused in connection with Koderma P.S. Case No. 116 of 2024, Corresponding to Special POCSO Case No. 28 of 2024, for the offences registered under Sections 376 & 506 of the I.P.C. and Sections 4/6 of the POCSO Act, 2012, pending in the Court of learned Additional Sessions Judge-1-Cum-Spl. Judge, POCSO Act, Koderma.
Bail application of the petitioner was earlier rejected by this court vide B.A. No. 10557 of 2024 by order dated 13.12.2024.
Petitioner is alleged to have raped the victim aged about 15 years. He also videographed the entire occurrence. Later, he made the video viral.
Learned lawyer for the petitioner submitted that the statement of the victim was recorded during the trial and there are contradictions in her evidence. It appears that the victim has supported the prosecution case in her examination-in-chief. It will not be proper to look into the contradictions in her statement in her cross- examination.
Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.
