1. The petitioner has filed the present petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 with a prayer to grant anticipatory bail in case FIR No.04, dated 31.01.2024, registered under Sections 406,420 of IPC, Police Station NRI, District Police Commissionerate Amritsar.
2. While granting the concession of interim anticipatory bail by a Co- ordinate Bench of this Court on 08.01.2025, the following contentions were noticed by this Court and the same have been reproduced below:-
“Counsel for the petitioner inter alia submits that the petitioner is a real brother of complainant who is residing in USA. Admittedly, complainant gave power of attorney with regard to management of his land in favour of the present peti- tioner and on the basis of said power of attorney, the petitioner leased out the land belonging to complainant to some other person. The only dispute between the parties is with regard to handing over of the lease amount to the complainant which was received by the petitioner and the entire dispute is primarily of civil nature. CRM-M-166-2025 -2 Counsel for the petitioner further submits that petitioner who retired as a Naib Tehsildar from Revenue Department is ready to join investigation with the police and is having no criminal antecedents”.

Learned counsel for the petitioner has reiterated the submissions and further submits that the petitioner has joined the investigation and his custodial interrogation may not be required.
4. Learned State counsel also submits that the petitioner has joined the investigation and is no longer required for further investigation.
5. In view of the above statement made by learned counsel for the parties, the interim order dated 08.01.2025 is made absolute. The petitioner shall continue to join the investigation, as and when called by the Investigating Officer. The petitioner shall also abide by the conditions as specified under Section 482 (2) of B.N.S.S.
