The Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner Nos.1 to 3/accused Nos.13, 7 and 5 to grant anticipatory bail in connection with Crime No.1 of 2021 of CID, Police Station, Mangalagiri. 2 2. A case has been registered against the petitioner Nos. 1 to 3/accused Nos.13, 7 and 5 and others, for the offences punishable under Sections 420, 409 read with 120B I.P.C. 3. Case of the prosecution is that during the period between 26.11.2018 and 23.07.2019 at A.P. State Urdu Academy, Vijayawada, the accused No.1, the Director/Secretary of the Academy conspired with A2-Accounts Officer along with other accused, committed financial fraud in the Academy by causing loss to the Academy to a tune of Rs.04.00 Crores. 4. A perusal of the material on record goes to show that all the allegations are directed against the A1 & A2. It appears that A1 & A2 selected their relatives i.e., from A2 to A17, who were favourable to them and implemented the conspiracy by creating accounts in their names and later withdrew amounts from their accounts and thereby misappropriated amounts and caused loss to the Government to a tune of Rs.04.00 Crores. The petitioners, being the relatives of the accused Nos.1 & 2, have not gained anything. As per the remand report and documentary evidence, it shows only the involvement of A9 and A10 along with A1 and A2. 5. In view of the facts and circumstances and considering the submissions of the learned counsel appearing on behalf of the petitioners, this Court is inclined to grant anticipatory bail to the petitioner Nos.1 to 3/accused Nos. 13. 7 and 5. 3 6. Accordingly, in the event of their arrest, petitioners/accused Nos.13, 7 and 5 shall be released on bail on executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each, with two sureties for the like sum each to the satisfaction of the arresting police officials and also on condition that the petitioners shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners shall appear before the Station House Officer concerned, once in a week i.e. on every Sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge sheet. 7. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending, shall stand closed. _____________________________ JUSTICE K.
