Ms. Manisha Rana Singh, D.A.G. for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in Sessions Trial No.33 of 2019, State Vs. Amit Kumar and Others, arising out of FIR No.290 of 2018, under Sections 498-A, 304-B IPC and Section ¾ of the Dowry Prohibition Act, 1961, Police Station Nehru Colony, District Dehradun. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. This is the third bail application. The first bail application, being BA1 No.2185 of 2019, was rejected on 21.08.2020. The second bail application, being BA2 No.51 of 2023, was dismissed as withdrawn on 29.03.2023. 4. Learned counsel for the applicant submits that the applicant is in custody since 31.10.2018; there are total 20 witnesses, out of which only 9 witnesses have been examined. 5. Learned State Counsel admits these facts. 6. Having considered the period of custody, which the applicant has already undergone and other attending factors, this 2 Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned.
