CMP-T No.84 of 2025 By way of this application, a prayer has been made to restrain the respondents from effecting recovery from the petitioner and further to direct them to return the recovered amount. Record reveals that on 09.02.2018, recovery in pursuance to Annexure A-2 was ordered to be stayed till further orders. There is nothing on record to reveal that order dated 09.02.2018 has been vacated or modified. That being so, the recovery already stands stayed and the same order cannot be passed. As regards the prayer for direction to return the recovered amount, the same can only be ordered, if the petitioner is found entitled, after hearing the parties finally in the petition.
