Instructions have come from the State side which are taken on record. 2. This writ petition has been filed with the following prayer:- "(I) Issue a writ, order or direction in the nature of mandamus to direct the respondent no.2 to reinstall the boundary pillar over the demarcated gata no.184 of petitioner situated at Revenue Village Majuri Khurd, Tehsil - Salempur, District Deoria." 3. Learned Standing Counsel submits that proceedings under Section 41 of the U.P. Land Revenue Act, 1901 was initiated which has been concluded by order dated 31.10.1994. The order was carried out on 26.12.2021 and the pillars were fixed. Thereafter, the boundary pillars got vanished due to floods and thereafter again pillars have been fixed after the revenue team inspected the site on 20.10.2024. 4. Learned counsel for the petitioner submits that though the demarcation has been carried out but the possession, till date, has not been handed over as it is under the encroachment of the private respondents. 5. Sri Dhananjay Kumar Thakur, counsel appearing for the private respondents submits that a restoration application has already been filed by the private respondents which is pending consideration. 6. As no useful purpose would be served in keeping the matter pending or calling for a counter affidavit, as already the prayer made in the writ petition to restore the boundary pillars which have been carried out on 20.10.2024 and a restoration application is pending in said matter, the writ petition is disposed of requiring the revenue authorities to proceed with the restoration application and decide the same strictly, in accordance with law, after hearing all the affected parties, within two months from the date of production of a certified copy of this order.
