JUSTICE SANJAY PARIHAR, JUDGE ORDE R 07.07.2025 Impugned in this appeal filed by the UT of JK under Section 21 of the NIA Act, is an order dated 6th September, 2022, passed by the learned Additional Sessions Judge, Designated Under NIA Act, Srinagar, [“hereinafter referred as trial court”] in FIR No. 6/2021 for the offences under Sections, 18/23/39 UAP Act, registered at police station Sadder, Srinagar, whereby the learned Special Judge has granted bail to the accused/respondents herein. The bail was granted by the learned Special Judge on 6th September, 2022, and ever since, the respondents are at large and attending the trial. There is no grievance projected by the appellant that, after being released on bail, the respondents have violated any of the terms and conditions of the bail. Otherwise also, as per the statement made by the learned counsel appearing for the appellant, only one more prosecution witness is required to be examined. That means the trial is at the stage of being finalized. We are, therefore, of the view that this is not the stage to interfere with the order of granting bail. For the aforesaid reasons, the appeal is found to be without any merit and is accordingly dismissed.
