The petitioner is aggrieved by a notice dated 27.08.2025, issued by respondent No.2 i.e. Executive Engineer, Irrigation Division, Dibiyapur, Auraiya, whereby the petitioner is required to file his explanation alongwith evidence before the said respondent and also appear before him on 11.09.2025, failing which the encroachment allegedly made by the petitioner over public road would be removed. 2. The specific case of the petitioner is that he has already replied to the impugned notice on 03.09.2025 but without deciding the same, respondent No.4 is threatening to dispossess the petitioner and demolish his constructions. 3. Having regard to the said submissions, we dispose of the instant petition with direction to respondent No.4 to pass a speaking order taking into consideration the reply of petitioner dated 03.09.2025, within six weeks from the date of communication of instant order and until decision is taken, no coercive action shall be taken against the petitioner. The petitioner shall file copy of the instant order before respondent No.4, positively, within two weeks from today, failing which the instant order will be of no avail and it shall be open for respondent No.4 to proceed further in the matter, in accordance with law.
