The learned counsel for the petitioner submits that the petitioner is convicted in C.C.No.377 of 2016 and an appeal was filed by him on the file of the Metropolitan Sessions Judge cum II Additional District Judge at Vijayawada. 2. It is submitted that the petitioner is unwell and he is suffering with various alignments. It is submitted that the petitioner’s counsel also could not appear on that day and as such, a non-bailable warrant was issued by the learned Metropolitan Sessions Judge- cum-II-Additional District Judge on 30.05.2023. It is further submitted that the learned Sessions Judge has directed the police to execute the warrant and issued a memo with effect from 20.02.2025. 3. The learned counsel for the petitioner submits that the application filed by the petitioner seeking the recall of the warrant cannot be considered by this learned Sessions Judge, as the warrant has been pending since 30.05.2023. The petitioner has filed an application for the recall of the warrant before the learned Metropolitan Sessions Judge-cum-II Additional District Judge, Vijayawada, under Section 374 of the BNSS.
