Learned counsel for the parties submit that the issue in question is squarely covered by the judgment rendered by a Division Bench of this Court in a batch of writ petitions led by W.P. (S) No. 6 of 2017 [Sunil Tudu Vs. The State of Jharkhand & Ors.] pronounced on 26.04.2024. 2. For the reasons stated in the aforesaid judgment, which shall apply mutatis-mutandis in the present case, the present writ petition is ordered to be dismissed. 3. However, it is made clear that since an S.L.P. has been filed against the aforesaid judgment, the rights of the parties shall be finally determined as per the judgment of the Hon’ble Supreme Court.
