GP FOR HOME (AP) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “....to issue any writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of respondents 2 to 4 in summoning the petitioners to police station to obtain finger prints, photos and ID cards for the purpose of opening of suspect 2 sheet as illegal and arbitrary and consequently direct the respondents not to take any steps to open suspect sheets against the petitioners holding that the said acts of the respondents are in violation of the fundamental rights guaranteed to me under Article 20 and 21 of the Constitution of India.” 2. Heard Sri Raja Reddy Koneti, learned counsel for the petitioners and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that no suspect sheet or rowdy sheet has been opened against the petitioners so far. The present petition has been filed by the petitioners merely on apprehension, with the intent to prevent the police from taking any action in the future. 4. For ready reference, the written instructions are extracted hereunder: “It is pertinent to submit that in the bail application, the Hon’ble Court categorically stated that “the petitioners/accused shall report before the Station House Officer, Krishnapatnam Port Police Station, Nellore District once in a week on every Monday between 10.00 am and 12.00 p.m till the entire investigation is completed or charge sheet is filed. I submit that so far, no suspect sheet or rowdy sheet whatsoever has been opened against the petitioners herein. I submit that to prevent the police from taking any action in future, the petitioner on mere apprehension filed the present writ petition without any cause of action.” 5. Recording the said submissions, the Writ Petition is disposed of. There shall be no order as to costs.
