HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 31921 of 2025 Court No. - 21 HON'BLE MANOJ KUMAR GUPTA, J.
HON'BLE ARUN KUMAR, J.
1. The instant writ petition has been filed praying for quashing of a report dated 15.7.2025 submitted by Tehsildar on the complaint filed by the petitioner on IGRS Portal in respect of her claim under the Mukhyamantri Krishak Durghatna Kalyan Yojana.
2. The report suggests that the claim of petitioner for compensation on account of death of her husband in a motor accident is not admissible, as the deceased, as per the age mentioned in Aadhar Card, was 71 years and 3 months at the time of death, whereas under the Government Order, the claim would be sustainable only if the age is not beyond 70 years.
3. Learned counsel for the petitioner submits that in postmortem report, the age is mentioned as around 65 years. He submits that the deceased was an illiterate person and the age mentioned in the Aadhar Card was only tentative. He further submits that in the Pariwar Register the age is mentioned as 10.1.1960, and consequently, at the time of accident, even according to age recorded in Pariwar Register, he was around 65 years.
4. It is not disputed before us that under the scheme, the claim has to be decided by the District Level Committee of which District Magistrate is the Chairperson.
5.
