Khandakar, learned counsel for the petitioner. Also heard Shri D. Gogoi, learned Standing Counsel, Forest Department, Shri B. Gogoi, learned Standing Counsel, Finance Department, Shri N. Das, learned counsel for the official respondent and Ms. S. Kemprai, learned Standing Counsel, KAAC. The grievance of the petitioner is in connection with a claim for payment of ex-gratia for loss of human life by attack of elephant. Shri Khandakar, the learned counsel for the petitioner has submitted that there is no instruction from the clients since long. Shri Gogoi, the learned Standing Counsel has submitted that though a scheme for such payment is available, the same has to be preceded by a factual determination by the concerned District Commissioner. Page No.# 3/3 In view of the above facts and circumstances, if such enquiry has not been done, the District Commissioner, Karbi Anglong may conduct an enquiry and take steps in accordance with law.
