GP FOR REVENUE (AP) following order: writ petition is filed assailing the action of the respondents in seeking to dispossess the 1st petitioner from an extent of Ac.0.90 cents in Sy.No.220/P, Ac.1.00 cents in Sy.No.221/P and 2nd petitioner from his land in an extent of Ac.1.00 cents in Sy.No.222/P situated at Matumadugu Village, Dakkili Mandal, SPSR Nellore District, without following due process of law M.Ravindra, learned counsel for the petitioners and learned istant Government Pleader for Revenue appearing for the respondents. IN THE HIGH COURT OF ANDHRA PRADESH [3458] THE HONOURABLE SMT JUSTICE KIRANMAYEE MANDAVA ...PETITIONER(S) ...RESPONDENT(S) the action of the respondents petitioner from an extent of Ac.0.90 cents in petitioner from his land in an extent of Ac.1.00 cents in Sy.No.222/P situated at Matumadugu Village, District, without following due process of law. and learned istant Government Pleader for Revenue appearing for the respondents. 3. Learned counsel for the petitioners argues that the petitioners have been in possession and enjoyment of the subject land, cultivating the same without any interruption. The learned counsel further contends that in recognition of their possession, the 3rd respondent issued proceedings, in F.Dis.No.171/1408, granting a patta in their favor, and pattadar passbooks and title deeds. 4. The learned counsel for the petitioners contends that the respondents' action in dispossessing them without issuing notice is not sustainable. 5.
Today, when the matter is taken up for hearing, the learned Assistant Government Pleader for Revenue has placed on record a copy of the written instructions received from the 3rd respondent-Tahsildar, dated 24.12.2024. A perusal of the same reveal that the Tahsildar has not initiated any action against the petitioners. Furthermore, the Tahsildar contends that no land distribution was done during Fasli 1408, and the classification of the land remains unchanged, classified as "forest poramboke" and AW Dry. 6. In view of the same, the learned Assistant Government Pleader for Revenue contends that the petitioners have approached this Court apprehending that action would be initiated against them. Therefore, he prays for dismissal of the writ petition. 7. Having regard to the contentions, this Court is of the considered view that the respondents shall not dispossess the petitioner without following due process of law. If any action is contemplated against the petitioners, they shall
follow the due procedure under law, providing sufficient opportunity to the petitioner. 8. The written instructions of the 3rd respondent-Tahsildar, dated
24.12.2024. are placed on record. 9. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, all pending miscellaneous applications shall stand closed. _______________________________ JUSTICE KIRANMAYEE MANDAVA
