HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - A No. - 13593 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
1. Heard learned counsel for the petitioner.
2. By means of this petition filed under Article 226 of Constitution of India, petitioner has prayed for a relief in the nature of writ of mandamus to command the respondents to make the payment of salary to the petitioner at the rate of minimum of the basic pay of Rs.18000/- per month as admissible to employees of forest department.
3. Learned Standing counsel submits that as per Government Order dated 24.09.2024 only those Class IV employees working on daily wage post in the forest department are entitled to wages at bar at the minimum pay scale of Rs.18000/- who have rendered 10 years of service. Since the petitioner has only rendered four years service in the forest department as daily wager, he may not be entitled for basic pay even in the judgment of State of U.P. v. Putti Lal and Sabha Shankar Dubey v. Divisional Forest Officer and others:(2002) 2 Versus Counsel for Petitioner(s) : Ramendra Kumar Shukla Counsel for Respondent(s) : C.S.C. Pavneesh Giri .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s)
UPLOBEC 1595 that was passed in setting of facts of the cases that arose at that point of time
4. From the perusal of the order, I find merit in the submission advanced by learned Standing Counsel. The said Government Order is also under challenge in this petition. The writ petition fails and is accordingly, dismissed.
5. However, it is provided at the same time that dismissal of this petitioner will not in any manner adversely effect the continuation of the petitioner in the forest department as daily wager as per availability of work.
