Heard the counsel for the petitioner and the A.G.A. for the State. The present writ petition has been filed praying for quashing the First Information Report dated 01.05.2025 pertaining to Case Crime No. 0139 of 2025, under Sections 125, 109, 288 B.N.S. Police Station-Collonelganj, Commissionrate Prayagraj. It has been stated in the writ petition that the petitioner was not named in the F.I.R. and has been falsely implicated in the case because of campus rivalry. A perusal of the F.I.R. shows that no one is injured in the case. The AGA has opposed the petition. In the circumstances of the case and after considering the rival arguments of the counsel for the parties, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 01.05.2025 pertaining to Case Crime No. 0139 of 2025, under Sections 125, 109, 288 B.N.S. Police Station-Collonelganj, Commissionrate Prayagraj till submission of the police report under Section 193 of Bhartiya Nyaya Sanhita, 2023.
