Issue a writ order or direction in the nature of mandamus directing/commanding the respondent no.2 and 3 to restrain the respondent no.4 to construct the Anganwadi building over petitioner's land measuring area 0.125Hq. of Aarazi No. 596 situated at village Pachauri Bhadaura, Tehsil Sewrai, District Ghaizpur till disposal of case filed by petitioner and his family members under section 30(2) of U.P. Revenue Code-2006 by respondent no. 2; ii. Issue a writ order or direction in the nature of mandamus directing/communing the respondent no.2 to decide the application of petitioner and his family members dated 26.8.2025 (Annexure-5 to this petition) within stipulated period;" 2. It is contended by learned counsel for the petitioner that proceedings under Section 30(2) of the U.P. Revenue Code, 2006, is pending consideration. The petitioner claims that Anganwadi building is constructed over his land in connivance with the village Pradhan. Already a stay application has been moved in proceedings under Section 30(2) which is pending consideration. The sole prayer made is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, without calling for counter affidavit, requiring the revenue authorities to first decide the stay application filed by the petitioner, if any, within a period of two weeks from the date of production of certified copy of this order and thereafter, to proceed to decide Versus Counsel for Petitioner(s) : Arun Kumar Srivastava Counsel for Respondent(s) : Bhupendra Kumar Tripathi, C.S.C.
