Heard Sri Prem Prakash Yadav, learned counsel for the petitioner as well as Sri Shravan Kumar Dubey, learned AGA appearing for the State respondents and perused the record. 2. Present petition has been filed challenging the impugned FIR dated 08.8.2025, registered as Case Crime No. 0162 of 2025, under Sections 308 (2), 127 (2), 351(3) BNS, 2023, P.S. Rajghat, District Gorakhpur. 3. At the very outset, learned counsel for the petitioner submits that he has received instructions that certain sections have been added during course of investigation, therefore, he prays that the petitioner may be permitted to withdraw the present petition with liberty to file a fresh one. He has also drawn the attention of the Court to the order dated 08.9.2025 passed in Crl. Misc. Writ Petition No. 19841 of 2025 Shubham Srivastava and Another vs. State of U.P. and 3 Others which was also permitted to be withdrawn on the same ground. 4. Present petition is accordingly dismissed as withdrawn with liberty aforesaid. 5. Office is directed to return the certified copy of the impugned FIR after retaining its photocopy on record.
