Order No:-03 Dated:-18-07-2025
Heard the parties.
This Civil Miscellaneous Petition has been filed by the petitioner with a prayer for restoration of W.P.(C) No.758 of 2017 to its original file which stood dismissed for non-prosecution.
Learned counsel for the petitioner submits that W.P.(C) No.758 of 2017 was listed before this Bench on 29.02.2024 but due to inadvertence, no one
turned upon on behalf of the petitioner in spite of repeated calls when the said W.P.(C) No.758 of 2017 was called up before the Bench; which resulted in dismissal of the said W.P.(C) No.758 of 2017 for non-prosecution. It is next submitted that non-prosecution of the said W.P.(C) No.758 of 2017 before this court was neither deliberate nor intentional. It is also submitted that the petitioner has very good grounds to agitate in the said W.P.(C) No.758 of 2017 and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the W.P.(C) No.758 of 2017 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner, W.P.(C) No.758 of 2017 is directed to be restored to its original file at the same stage at which it was before its dismissal.
Registry is directed to list W.P.(C) No.758 of 2017 before the concerned Bench after a week.
This Civil Miscellaneous Petition is disposed of accordingly.
