NIDHI GUPTA, J. (ORAL) Appellant-defendant No. 1 is in second appeal against the concurrent findings of both the Courts below whereby the suit for filed by respondents No. 1 and 2-plaintiff
Perusal of the order-sheet(s) reveals to the year 2017; and notice of the application for declaring the applicant appellant as indigent person as well as in the main appeal was ordinate Bench of this Court vide order dated 14.12.2018. when this case was listed for hearing on 03.09.2019, fresh notice to respondent No. 3 were ordered to be issued on furnishing of her latest address along with requisite process by learned counsel for the appellant.
As per office report, the order dated 03.09.2019, has not been complied with till date as learned counsel for the appellant has not filed Foreign AD for effecting service upon respondent No. 3, till date the last more than 05 years.
Today, a written request for an adjournment has been circulated by learned counsel for the appellant on the ground that he is in some personal difficulty, which is not justifiable.
