Order on Board 27.06.2025
1. The petitioners have filed this petition seeking the following relief(s):-
“10.1 That the Hon'ble Court be pleased to call for the entire records in connection of the petitioner's cases.
10.2 That the Hon'ble court be further pleased to quash the impugned order dated 01.07.17 (Ann.P/1) passed by the Respondent No.3 and direct the Respondent authorities to grant regular status of service and other service benefits to the petitioners from the date of initial appointment as other similar situated employees have been granted. 10.3 Any other order that the Hon'ble Court deems fit and necessary in the circumstances of the case be also passed. 10.4 That the cost of the petition be also awarded to the petitioners.”

2. It is pleaded that the petitioners were appointed between 1982 to 1997 under the respondents on different posts. Their services were regularized in the year 2008. The petitioners by way of this petition have claimed regular status as well as service benefits from the date of their initial appointment. 3. Mr. Shukla, learned counsel appearing for respondent No.3/Municipal Corporation would submit that according to the circular issued by the State Government dated 05.03.2008, the employees would be treated as regular employees from the date of their regularization. He would further submit that the services of the petitioners were regularized in the year 2008, therefore, they have no right to claim regularization and other benefits from the date of their initial appointment. 4. Mr. Tiwari, learned Panel Lawyer appearing for the State would support the contentions made by Mr. Shukla. 5. Heard the learned counsel appearing for the parties and perused the documents placed on the record. 6. Admittedly, the services of the petitioners were regularized pursuant to the decision taken by the Municipal Corporation and the sanction set up. Initially, they were appointed as daily rated employees and their services were regularized in the year 2008 but the petitioners never challenged that condition mentioned in orders of regularization and filed this petition on 19.02.2018
-4- claiming therein regularization from the date of initial appointment including other benefits. 7. The petitioners kept mum for a period of 8 years and in para 7, they have not explained reasons for such a delay.
Further, the petitioners have not annexed any circular or order issued by the State Government to claim regularization from the date of their initial appointment. 8. Taking into consideration the above-stated facts, I do not find any good ground to entertain this petition. Thus, this petition fails and is accordingly, dismissed. No cost(s). Sd/-
