Heard learned counsel Mr. T.Gogoi for the petitioner Mahendra Boruah who has filed this application under Section 482 of the BNSS, 2023 praying for pre- arrest bail apprehending arrest in connection with Dhemaji PS Case No. 36/2025 under Section 64/351(2) of the BNS, 2023. The allegation against the petitioner is that he repeatedly committed sexual assault on the victim which led the victim to react. 4. Learned Addl.Public Prosecutor has submitted that there are incriminating materials in the Case Diary against the petitioner. 5. I have also scrutinized the Case Diary. Indeed there are incriminating materials against the petitioner in the Case Diary. At this juncture, there appears to be no justified ground to extend the privilege of pre-arrest bail to the petitioner. 6. The pre-arrest bail application stands rejected at this stage. 7.
