Heard learned counsel for the applicant and learned AGA for the State. 2. This application under section 528 BNSS has been preferred to quash the impugned charge-sheet dated 07.10.2024 as well as summoning/cognizance order dated 14.10.2024 including the entire proceedings of Special Session Trial No. 2268 of 2024 (State vs. Raja Ilhak and others) arising out of Case Crime No. 674 of 2023, under Sections 2/3 of Uttar Pradesh Gangster and Anti-Social Activities (Prevention) Act, 1986, Police Station Firozabad South, District- Firozabad, pending in the court of learned Special Judge (Gangster Act)/Additional Sessions Judge, Court No. 9, Firozabad as well as to stay the further proceedings of abovementioned case. 3. In the matter of co-accused, Raja @ Ilhak, in Application u/s 482 No. 2087 of 2025, vide order dated 16.04.2025, this Court has set-aside the aforesaid proceedings and allowed the application u/s 482 Cr.P.C.. 4. Be that as it may, no useful purpose will be served in keeping the matter pending by way of granting one more opportunity for filing detail counter affidavit and thereafter for rejoinder affidavit in favour of the applicant and as such, the proceedings put under challenge precisely on the grounds as mentioned above is strictly not followed which is apparent from the records and as such the of Special Session Trial No. 2268 of 2024 (State vs. Raja Ilhak and others) arising out of Case Crime No. 674 Versus Counsel for Applicant(s) : Akhilesh Srivastava, Saksham Srivastava Counsel for Opposite Party(s) : G.A. Badrul Rehman .....Applicant(s) State of U.P. and Another .....Opposite Party(s) of 2023, under Sections 2/3 of Uttar Pradesh Gangster and Anti-Social Activities (Prevention) Act, 1986, Police Station Firozabad South, District-Firozabad, pending in the court of learned Special Judge (Gangster Act)/Additional Sessions Judge, Court No. 9, Firozabad is hereby set aside in respect to applicant herein. 5.
