Hon'ble Brij Raj Singh,J. 1. In pursuance of order passed by this Court on 11.09.2024, instructions has been received and the same is taken on record. 2. As per instructions dated 16.09.2024, it is evident that the final decree can be executed by S.D.M., but the petitioner has given application before respondent no. 2 i.e. Additional Sub District Magistrate, Tehsil-Bareilly, Bareilly which is not maintainable. 3. In view of the aforesaid instructions and as per arguments advanced on behalf of learned Standing Counsel, I direct the petitioner to file a fresh application in accordance with the Rules before the competent authority i.e. S.D.M. Bareilly concerned within two weeks from today. 4. Accordingly, the writ petition is disposed of with liberty to the petitioner to file a fresh application in accordance with the Rules within two weeks from the date of production of certified copy of this order. Thereafter, the Sub-Divisional Magistrate Bareilly will decide the application within three months after affording opportunity to the aggrieved parties without prejudice to their rights in accordance with law.
