Vivek Singh Thakur , Judge (Oral) In sequel to order passed on previous date, learned Additional Advocate General submits that as per instructions eviction proceedings in the present matter are yet to commence. 2. Learned Additional Advocate General has also placed on record instructions dated 23.09.2025, received from Divisional Forest Officer, Theog, Forest Division Theog, whereby it has been informed that application for demarcation of the encroached land has been submitted in the office of Tehsildar Kotkhai, as it is pre-requisite for challaning the case before the Collector-cum-Divisional Forest Officer, Theog. 2 2025:HHC:33339-DB 3. On instructions, received from Range Forest Office, Kotkhai, learned Additional Advocate General submits that demarcation is going to be conducted within two weeks and immediately thereafter appropriate action shall be taken by the concerned officer to initiate/commence eviction proceedings against the encroachers. 4. The concerned officers of the State are directed to adhere to the timeline for deciding the said cases as framed by the Apex Court in Civil Appeal No. 13362 of 2024, titled Babu Ram vs. State of H.P., as well as this High Court and also as notified/circulated by the Additional Chief Secretary (Revenue) as well as Additional Chief Secretary (Forest). 5. After completing the eviction proceedings, status report shall be filed on the affidavit of Divisional Forest Officer, Theog. 6.
