(ORAL) The present civil writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing/setting aside the impugned office order dated 21.03.2025 (Annexure P-10) passed by respondent No.1 and setting aside the office order No.319 dated 27.05.2024 (Annexure P-6) by SE/HR, UHBVN, Panchkula. Learned counsel for the petitioner inter alia contends that disciplinary proceedings were initiated against the petitioner only on the basis of show cause notice. Admittedly, no charge sheet detailing therein the exact charge against the petitioner was ever issued to the petitioner. The entire disciplinary proceedings is void due to the non-compliance of the mandatory procedure under Rule 4 of UHBVN Employees (Punishment and Appeal) Regulation, 2018 (hereinafter referred as ‘Regulation 2018’). In view of the above and in terms of the statement made by counsel for the respondents-Corporation, the present writ petition is disposed of and impugned orders dated 21.03.2025, 27.05.2024 and 27.11.2024 (Annexures P-10, P-6 & P-8, respectively) are hereby set aside. However, liberty is granted to the respondents-Corporation to proceed further to issue a fresh charge sheet.
