The petitioner has filed the present writ petition under Article 226/227 of the Constitution of India with a prayer to issue a writ in the nature of Mandamus directing the respondent authorities to decide the legal notice dated 10.05.2024 (Annexure P-8) in a time bound manner and to release the pension, gratuity, leave encashment and other retiral benefits to her along with 10% rate of interest on the delayed payments. 2. Learned counsel for the petitioner contends that he shall be satisfied at this stage, in case, appropriate directions are issued to the respondents to decide the legal notice dated 10.05.2024 (Annexure P-8) in the light of the judment passed by this Court in CWP-20597-2016 (O&M), titled as “Rakesh Kumar Vs. State of Punjab”(Annexure P-10). 3. Notice of motion. 4. I have heard learned counsel for the parties and perused the record carefully. 6. The respondent No.2 is directed to decide the legal notice dated 10.05.2024 (Annexure P-8) submitted by the petitioner within a period of three months from today. 7. It is expected that the respondent No.2 shall decide the legal notice dated 10.05.2024 (Annexure P-8) by passing a well reasoned and speaking order and shall also examine the law laid down by this Court in CWP-20597- 2016 (O&M), titled as “Rakesh Kumar Vs. State of Punjab”(Annexure P-10) 8. In case, the petitioner is found entitled to any relief, the same shall be granted to her within a period of 02 months thereafter. 9. Disposed of.
