JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 28.03.2025 Heard learned counsel Mr. M Khan for the petitioner Abdul Latif Sk @ Abdul Latif who has filed this application under Section 483 of the BNSS, 2023 for prayer of bail as he is apprehending arrest in connection with Gauripur PS Case No. 64/2025 under Section 61(2)/125(b)/117(2)/118(2)/109(1) of BNS, 2023. Page No.# 2/2 The allegation against the petitioner is that he threw a brick towards the victim Jahirul Hoque and thereafter, he along with his brothers and father assaulted the victim causing grievous injuries on his person. I have considered the submissions at the bar. I have also scrutinized the Case Diary. The victim has sustained grievous injuries on different parts of his body. There are incriminating materials in the case diary against the petitioner. The petitioner has been behind bars since 12.02.2025. It appears that further custodial detention may not be required. Considering all aspects, the petitioner is enlarged on bail of Rs 30,000/- with a suitable surety of like amount to the satisfaction of the C.J.M, Dhubri under the conditions that (1) the petitioner shall refrain from such activities with which he is alleged, (2) the petitioner shall not exercise threats to the witnesses, and (3) The petitioner shall not leave the jurisdiction of the Court without prior permission. On the breach of any of the bail conditions, the learned Court is at liberty to cancel the bail granted to the petitioner. Send back the Case Diary. JUDGE Comparing Assistant
