Heard the counsel for the petitioner and the A.G.A. for the State. The present petition has been filed praying for the following reliefs:- "(a) Issue a writ, order or direction in the nature of mandamus commanding the respondent Nos. 2 and 3 to to conclude/transfer the Case Crime No. 0069 of 2023, under Sections 419, 420, 467, 468 and 471 I.P.C., Police Station-Mutthiganj, District- Prayagraj to S.I.T. or any investigating wing for proper investigation and conclude investigation within a specific period in the interest of justice. (b) Issue a writ, order or direction in the nature of mandamus commanding the respondent No. 3 proper investigation and conclude investigation within a specific period to arrest the accused person in Case Crime No. 0069 of 2023, under Sections 419, 420, 467, 468 and 471 I.P.C., Police Station-Mutthiganj, District- Prayagraj." There is nothing on record to show that the concerned Investigating Officer is not acting impartially and is not conducting a fair investigation. In view of the aforesaid, the writ petition is disposed of observing that in case, the petitioner has any grievance against the manner of investigation, he may file an application before the Police Versus Counsel for Petitioner(s) : Ravi Shankar Vishwakarma, Umesh Kumar Prajapati Counsel for Respondent(s) : G.A. Ramesh Kumar Prajapati .....Petitioner(s) The State Of U.P. And 3 Others .....Respondent(s) Commissioner, Commissionerate Prayagraj, District-Prayagraj who is expected to ensure that investigation is done in accordance with law and as prescribed under the Code of Criminal Procedure, 1973/Bharatiya Nagarik Suraksha Sanhita, 2023.
