JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 2 16-09-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Laukahi P.S. Case No. 103 of 2024 dated 01.06.2024 registered for the offences punishable u/s 302 read with Section 34 of the Indian Penal Code. 3. As per the prosecution case, the informant's son was in a relationship with one Arti Kumari daughter of the co- accused, Ramlakahn Yadav. On 31.05.2024, in the night, the informant's son namely, Abhimanyu went to meet Arti Kumari and he did not return. Next morning, the informant came to Patna High Court CR. MISC. No.63076 of 2025(2) dt.16-09-2025 2/3 know from nearby people that a dead body was lying near the pond and when the informant reached the place of occurrence, he saw the dead body of his son. It is further alleged that the informant's son was assaulted and strangled to death and the dead body of the deceased was thrown in the pond. The informant apprehended that the petitioner and the co-accused persons have committed murder of his son by strangulating and thrown the dead body near the pond. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The informant is not an eye witness to the alleged occurrence. The petitioner is the mother of Arti Kumari and due to enmity, the petitioner has been made accused in this case. There is no specific allegation against the petitioner rather the specific allegation of strangulating the informant's son to death is against the co-accused, Ramlakhan Yadav. The petitioner has no concern with the alleged offence. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is a lady and she is in custody since 02.06.2024. 5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Madhubani in connection with Laukahi P.S.
