CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 25-11-2025 These three petitions arise out of the same case i.e. Beur P.S. Case No. 61 of 2025 and accordingly, they are being heard together and disposed of with this common order.
2. Heard learned counsel for the petitioners and learned APP for the State as also the informant.
3. The petitioners are apprehending their arrest in Beur P.S. Case No. 61 of 2025 registered under Section-140(2) of B.N.S.
4. The informant states in her fardbeyan that her husband who was a carpenter went out from the house saying that he would return soon but he did not return. The mobile phone of her husband was found switched off. Her husband has become traceless.
5. It has been submitted on behalf of the petitioners that the petitioner Puja Kumari (in Cr. Misc. No. 62762 of 2025) is mother-in-law of the deceased and the petitioner Abhinay Kumar (in Cr. Misc. No. 63834 of 2025) is father-in-law of the deceased whereas Navneet Ram (in Cr. Misc. No. 34722 of 2025) is said to be the person with whom, the mother of the informant had illicit relation. According to submissions of
learned counsel for the petitioners, they are are innocent and
Patna High Court CR. MISC. No.62762 of 2025(3) dt.25-11-2025 3/3 have falsely been implicated in this case. It has further been submitted that when the informant came to know the real fact, she has compromised the case.
6. On the otherhand, the learned counsel appearing for the informant has submitted that the petitioner Abhinay Kumar is father of the informant. The informant, in her restatement has stated that she solemnized love marriage with the deceased, which was not acceptable to her family members and her family members were angry due to solemnization of marriage of the informant with the deceased. Learned counsel has submitted that Shyam Babu Bind who committed murder of the deceased has given vivid description of the entire occurrence and lastly, he has stated that he killed the deceased by firing shots in his head. The accused persons including the petitioners had hatched the conspiracy of the murder of the deceased.
6. Considering the aforesaid facts and circumstances, the petitioners do not deserve the privilege of anticipatory bail and accordingly, the same is rejected.
