This writ petition has been filed with the following prayer:- "I. A writ order or direction in the nature of Mandamus directing the respondents not to demolish/dispossess the petitioner from his house situated in Village Majhawam, Pargana, Tehsil and District Kanpur Nagar without following the proper procedure of law under Section 67 of U.P. Revenue Code 2006." It is contended that in the year 1995, proceedings under Section 122-B of U.P.Z.A. & L.R. Act were initiated and on the objections of the petitioner, proceedings were dropped. According to petitioner, after more than 30 years, proceedings under Section 67 has been initiated against the petitioner for eviction. Learned Standing Counsel has invited the attention of this Court to the instructions which has been placed before this Court today, according to which, the proceedings are not for plot no.990, in fact the encroachment has been done over plot no.1067. As the instructions clearly reveal that the eviction proceedings are being carried out on plot no.1067 and not on plot no.990, no case for interference is made out as the case of the petitioner is that he is residing on plot no.990. Petitioner has a remedy of filing objection before authority concerned disclosing the fact that his house is situated on plot no.990, and proceedings under Section 122-B of U.P.Z.A. & L.R. Act were dropped. In case, the said objection is filed, the same shall be decided by the authority concerned strictly in accordance with law.
