THE HON'BLE SRI JuSTICE K| SREENIVASA REDDY Criminal Petition No.2191 of 2025 HiLEIT+ This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/ accused, seeking anticipatory bail, in Crime No.32 of 2025 of Prohibition and Excise Station, Rajamahendravaram-South, East Godavari district.
2. A case has been registered against the petitioner herein for the offence punishable under Section 7-B read with 8-B and 8-A of the A.P. Prohibition (Amendment) Act, 2020. 3, Case of the prosecution is that on 12.01.2025, at about 04.30 PM, the Sub-Inspector of Police, Prohibition and Excise Station, Rajamahendravaram-South, along with her staff, proceeded to backside of Cement Bricks Factory, left side the way leading to Puntyakshatram to G. Yerrampalem in Punyakshatram village of Rajanagaram Mandal and found one person stirring with a stick in a plastic drum. On seeing the raid party, the said person ran away from the spot. The police verified the scene and found 400 litres of FJ Wash in 2 plastic drums, which was fit for distillation of ID liquor, and 70 litres of ID liquor in 2 black plastic cans. The police identified the person ran away as accused. After collecting samples, the police seized the remaining ID liquor and destroyed the drums with remain'lng FJ Wash under cover of a special report and registered a case against the accused.

In view of the aforesaid facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner herein On the following conditions. i) In the event of arrest of the petitioner in the aforesal'd crime, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two suretI'eS Of the like sum each to the satisfaction of the concerned Arresting Officer. ii) Petitioner shall cooperate with the investigation and he shall make himself available for interrogation by a police officer as and when required, and he sha" not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. iii) Petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 AM and 1.00 PM, till filing of the charge sheet.
7. The Criminal Petition is, accordingly, allowed, As a sequel thereto, the miscellaneous petitions, if any, Pending in this Criminal Petition, shall stand closed.
