The petitioner has been made accused in connection with Seraikella P.S. Case No. 161 of 2023, corresponding to G.R. No.87 of 2024, S.T. No.116 of 2024, for the offence registered under Section 120-B of the Indian Penal Code and Sections 25(1-B)(a)/25(6)/25(8)/26/35 of the Arms Act, pending in the court of learned Principal District & Sessions Judge at Seraikella. Bail application of the petitioner was earlier rejected by this Court in B.A. No. 9362/2024, vide order dated 12.11.2024. On 15.12.2023, petitioner was apprehended by Seraikella Police from Aambagan, Titirbila and on search, loaded country made pistol was recovered from his possession. It was submitted that petitioner is in custody since 16.12.2023 and offence alleged is triable by the Court of Judicial Magistrate. Learned A.P.P on behalf of the State has opposed the prayer for bail and submitted that petitioner is an accused of as many as 30 cases. Learned counsel for the petitioner has further submitted that petitioner has been acquitted in 18 of those cases. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail is hereby rejected at this stage. Learned Trial Court shall expedite the trial and preferably, conclude the same within six months from the next date fixed for recording of evidence. If the trial is not concluded within the aforesaid period, petitioner if so, advised may renew his prayer for bail. (Ambuj Nath, J.) BS/-
