2. By way of the present writ application, the petitioner has challenged the order dated 09.04.2016 passed by the District Education Appellate Tribunal, Banka by which, the suit (Suit NO. 06 of 2024) of the petitioner has been dismissed.
3. At the outset, learned counsel for the State submits that the order passed by the District Appellate Authority, Banka, impugned herein, is appelable before the
Patna High Court CWJC No.15889 of 2017(3) dt.23-09-2025 2/2 State Appellate Authority and the petitioner without availing the remedy of appeal has directly approached this Court in the present writ petition.
4. Considering the aforesaid, this writ petition is
disposed with a direction to file an appeal before the State Appellate Authority within one month. If an appeal is filed within one month from today, with condonation of delay petition, the State Appellate Authority shall consider the same and shall dispose the appeal on its own merit, in accordance with law, within a reasonable time frame preferably within a period of six months.
