Pending suit, the respondent filed an application in IA.No.2 of 2022 seeking attachment before judgment. Since the appellant herein failed to furnish security as ordered by the court below, an order was passed allowing the application seeking attachment before judgment in respect of two items of the property mentioned therein. Aggrieved by the same, the appellant/ defendant has filed this appeal. 3. When the appeal is taken up for hearing, the learned counsel for the appellant filed an undertaking affidavit dated 07.04.2025 stating that the appellant will not alienate the property described as item 1 in I.A.No.2 of 2022 till the disposal of the suit in O.S.No.417 of 2022 on the file of Special Court for Trial of cases under SC/ST (POA) Act, Namakkal. 4. In view of the undertaking filed by the Appellant, the learned counsel for the Appellant seeks raising of attachment in respect of item 1 of the property. In view of the undertaking affidavit filed by the appellant that he will not alienate or encumber item 1 of the property described in IA.No. 2 of 2022, the order passed by the trial court attaching the 1st item before judgment is set aside and the attachment stands raised in respect of item 1. Since no undertaking affidavit has been filed in respect of item 2, the order of attachment passed by the trial court in so far as item 2 is affirmed. 8. Accordingly, the civil miscellaneous appeal is disposed of by recording the undertaking affidavit filed by the appellant and raising the attachment in respect of item 1.
