Rai, Advocate For the State : Md. Azeemuddin, Addl.P.P ------ Order No.02 Dated-17-04-2025 Heard the parties. The petitioners have been made accused in connection with Chas (M) P.S. Case No.10 of 2025 registered for the offence punishable under Sections 103/238/3(5) of the B.N.S., 2023. Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners in furtherance of common intention with the co-accused persons committed murder of Shahjahan Sain and caused disappearance of the evidence of the murder by throwing the dead body in a pond. It is next submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-9 of the instant bail application, learned counsel for the petitioners submits that the petitioners have no criminal antecedent. It is then submitted that except the confessional statement of the petitioner No.1 and suspicion, there is no material in the record to implicate the petitioners in this case as no motive has been attributed to them. It is then submitted that there is no eye-witness in this case and the name of the petitioner No.2 has been transpired based on circumstantial evidence. It is further submitted that the petitioners have been in custody since 23.01.2025 as mentioned in para-1 of the instant bail application. It is also submitted that the co-accused, with similar allegations, has been admitted to bail by a Co-ordinate Bench of this Court vide order dated 28.03.2025 passed in B.A. No.2522 of 2025. It is lastly submitted that the petitioners undertake to co-operate with the trial of the case. Hence, it is submitted that the petitioners be released on bail. Learned Addl.P.P. appearing for the State opposes the prayer for bail of the petitioners. Considering the facts of this case, the above-named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bokaro in connection with Chas (M) P.S. Case No.10 of 2025 with the condition that they will co-operate with the trial of the case and furnish their mobile numbers and photocopy of the Aadhar Cards in the court below with an undertaking that they will not change their mobile numbers during the trial of the case.
