The challenge in this petition is made to the order dated 15.07.2024, passed by the respondent no.1/State of Uttarakhand, by which the Authorised Controller was appointed for Mahadevi Kanya Pathshala (PG) College, Dehradun (“the college”). Heard. This matter is heard on multiple occasions. Today, learned State Counsel gives a statement that by virtue of interim order passed by this Court, there is a lot of difficulty in running the college; salary could not be paid to the employees. Therefore, State of Uttarakhand has decided to withdraw the impugned order within a week. He submits that thereafter, after examining, the State of Uttarakhand may proceed to appoint Authorised Controller in accordance with law. Learned counsel for the petitioner submits that the State of Uttarakhand may withdraw the impugned order, but liberty may not be granted to the State to appoint the Authorised Controller now because three times in the past, the Authorised Controller has already been appointed by the State of Uttarakhand, and those orders were questioned and not acted upon finally. The Court takes on record the statement given by learned State Counsel. Since a statement is given that the impugned order shall be withdrawn within a week, nothing survives in this writ petition. It stands disposed of, accordingly. Insofar as liberty to appoint Authorised Controller in accordance with law is concerned, the State of Uttarakhand is always free to proceed under the provisions of the Uttar Pradesh State Universities Act, 1973.
