JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Someshwar Roy, Advocate For the O.P. No.2 : Ms. Nirupama, AC to SR. SC-II For JMADA : Mr. Santosh Kr. Jha, A.C. to Mr. Mahavir Pd. Sinha, Advocate ----- Order No.16 Date: 17.01.2025 1. The present contempt case has been filed for initiating contempt proceeding against the opposite party no.1 for his wilful and deliberate violation of the order dated 16th August, 2023 passed in W.P. (S) No.3295 of 2023. 2. Mr. Santosh Kumar Jha, learned A.C. to Mr. Mahavir Pd. Sinha, learned counsel appearing on behalf of the opposite party no.1 refers to the order dated 21st November, 2024 passed by the opposite party no.1 annexed with the show cause affidavit dated 21st December, 2024 and submits that the balance amount of Rs.22,13,747/- will be paid to the petitioner in terms with the scheme for payment of retiral benefits to the retired employees/dependents of employees of JMADA who have died. 3. As against this, learned counsel for the petitioner submits that the order dated 21st November, 2024 passed by the opposite party no.1 does not disclose headwise details of the said dues to be paid by the JMADA to the petitioner. 4. Having heard learned counsel for the parties and considering that the opposite party no.1 has already passed an order dated 21st November, 2024, there is no need to proceed further in the matter. The contempt proceeding as against the opposite party no.1 is hereby dropped. 5. The present contempt case is stands disposed of. 6. The opposite party no.1 shall, however, provide the details of Rs.22,13,747/- which has been shown to be paid to the petitioner within three weeks, failing which the petitioner will be at liberty to prefer a fresh contempt petition in this regard.
