GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.5591 of 2025 ORDER: The present Writ Petition is filed by the Petitioners in anticipation of dispossession from their respective shops in Seshagiri Rao Choultry bearing Nos. 1,2,3,4 and 5 situated in Town Survey No.122, Anantapur Municipal Corporation Area, Anantapur. 2. The Petitioners claim to be in possession of the shops for the last 50 years. The Petitioner No.1 had filed O.S.No.583 of 2014 before the Principal Junior Civil Judge, Anantapur, against the Respondent No.2 herein and the Assistant Commissioner of Endowment, Anantapuramu, seeking Permanent Injunction vis a vis their shops. The said suit was decreed on 30.06.2015 and the same had attained finality as no appeal is filed against the Order dated 30.06.2015. The Petitioner Nos. 2 to 4 also claim to be in a similar situation as Petitioner No.1 though they did not file any suit. 3. The learned Standing Counsel would submit that due procedure would be followed by Respondent Corporation. 3 4. Considering the submissions made by both the counsel and the established possession of the Petitioners in the subject land, it would be appropriate to dispose of the Writ Petition with a direction to the respondents to follow due process of law in case the respondent authorities are of the opinion that the Petitioners as encroachers of public place. 5. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
