3. Mr. Kanti Ram Sharma, learned counsel holding brief of Mr. Yogesh Upadhyay, learned counsel for the respondent nos. 3 to 5.
4. The present criminal revision under Section 397/401 of CrPC is moved on behalf of the revisionists, Jageer Singh S/o Gurdev Singh, Smt. Balvinder Kaur W/o Jageer Singh, Harjeet Singh S/o Jageer Singh, Chamkaur Singh S/o Iqbal Singh and Sukhvinder Singh S/o Jarnail Singh against the Respondents, Satpal Singh (deceased) S/o Gurdev Singh, Karnail Singh S/o Gurdev Singh, Smt. Nirmal Kaur W/o Karnail Singh and Harpreet Singh S/o Jagtaar Singh; the present criminal revision comes with the prayer to set-aside the impugned order dated 28.11.2013 as well as the entire proceedings of Sessions Trial No.277 of 2013, titled as “State vs. Jageer Singh & Others” presenting pending before the court of 2nd Additional Sessions Judge, Rudrapur, District Udham Singh Nagar for the offences punishable under Sections 147, 148, 149, 452, 307, 325, 504 & 506 of IPC on the basis of amicable settlement between the parties.
5. As per the order sheet dated 04.09.2025, whereby the
learned counsel for the revisionists had submitted that the parties have arrived at a compromise and that one of the concerned parties, Respondent no.5, Harpreet Singh S/o Jagtaar
2025:UHC:7930 Singh, is presently in judicial custody at Sub-Jail, Haldwani and was directed to be present through V.C. through Jailor, Sub-Jail Haldwani.

The Revisionist no.1, Jageer Singh S/o Gurdev Singh, Revisionist no.3, Harjeet Singh S/o Jageer Singh, Revisionist no.4, Chamkaur Singh S/o Iqbal Singh, Revisionist no.5, Sukhvinder Singh S/o Jarnail Singh and Respondent no.3, Karnail Singh S/o Gurdev Singh, Respondent no.4, Smt. Nirmal Kaur W/o Karnail Singh and Respondent no.5, Harpreet Singh (through V.C.) S/o Jagtaar Singh are present, who are identified by their respective counsel.
7. As per the order sheet dated 17.06.2025, the Revisionist no.2, Smt. Balvinder Kaur W/o Jageer Singh and Respondent no.2, Satpal Singh S/o Gurdev Singh have died. As per the
learned counsel for the revisionists, death certificate in this regard has been filed.

The Compounding Application (IA No.03 of 2023) is also annexed with the signatures of the parties with the present criminal revision that is supported with the affidavits of the parties and the said application is being endorsed by the learned counsel for the Revisionists and Respondent nos. 3 to 5, Mr. Lalit Sharma, Advocate and Mr. Kanti Ram Singh, learned counsel holding brief of Mr. Yogesh Upadhyay, Advocate respectively.

After interacting with the parties, they make a statement that the dispute has been settled amicably between the parties, now the Respondent nos. 3 to 5 did not want to pursue the matter further against the Revisionists, therefore, the proceedings and other consequential order, arising out of the F.I.R. in question may be quashed.

10. The said compounding application is strongly opposed by the learned State counsel on the ground that some of the offences are non-compoundable.

In view of the principle of law laid down by Hon'ble the Apex Court in the case of “Gian Singh vs. State of Punjab” reported in 2012 (10) SCC 303 as well as in Transfer Petition (Criminal) No. 115 of 2012 (Dimpey Gujral vs. Union Territory of Chandigarh) decided on 06.12.2012, criminal proceedings can be quashed by this Court, if this Court is satisfied with the
facts and circumstances of the case.
12. Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the entire proceedings against the Applicant are hereby quashed.
13. In view of the above, the compounding application is allowed. The impugned order dated 28.11.2013 passed by learned Session Judge, Rudrapur, District Udham Singh Nagart as well as the entire proceedings of Sessions Trial No.277 of 2013, titled as “State vs. Jageer Singh & Others” presently pending before the court of 2nd Additional Sessions Judge, Rudrapur, District Udham Singh Nagar for the offences punishable under Sections 147, 148, 149, 452, 307, 325, 504 & 506 of IPC, are hereby quashed.
14. Present criminal revision is, thus, disposed of in terms of the compromise arrived at between the parties.
