Since the common facts and grounds involved in all these petitions, they are being considered and decided by this common order. For the sake of convenience, the pleadings and documents of WPS No.11180 of 2025 are being referred. 29 WPS No.11180 of 2025 & other connected matters 2. In all these petitions, the petitioners sought a direction towards the Respondent Authorities to consider them as regular employees as per Rule 7 (4) of the Chhattisgarh Rajya Prathmik Vanopaj Sahakari Sanstha Prabandhak Seva (Niyojan, Nibandhan Tatha Karya Stithi) Niyam (for brevity ‘the Rules’) and grant them permanent salary from the date of their appointment after completion of their probation period with consequential benefits. 3. (a) Learned counsel for the petitioners would submit that the petitioners have been working as Managers in different Primary Minor Forest Produce Cooperative Societies since a long period under the respondent No.2 and their services are governed by the provisions of the Rules i.e. Chhattisgarh Rajya Prathmik Vanopaj Sahakari Sanstha Prabandhak Seva (Niyojan, Nibandhan Tatha Karya Stithi) Niyam. It is contended that in terms of Rule 7(4) of the said Rules, after successful completion of one year of probation, the petitioners became entitled to regularization/permanent status and consequential monetary benefits. It is further submitted that though the appointment orders were issued by the Primary Cooperative Societies, the entire administrative, financial and functional control over the Primary Societies vests with the Chhattisgarh State Minor Forest Produce Cooperative Federation (henceforth ‘the Federation’). Reliance is placed upon the provisions of the Rules, the by-laws, Gazette Notification dated 20.04.2001 etc. to contend that the Federation 30 WPS No.11180 of 2025 & other connected matters exercises complete control over appointments, service conditions, financial management and functioning of the Primary Societies. It is argued that the Federation cannot avoid its responsibility by merely describing itself as a supervisory authority. (b) Learned counsel would further submit that despite recommendations and various communications, the respondents have failed to grant the benefit of regularization, thereby subjecting the petitioners to hostile discrimination in violation of Articles 14 and 16 of the Constitution of India. Learned counsel would submit that employees who have rendered long and continuous service cannot be denied regularization merely on technical or procedural grounds. It is lastly submitted that the Federation exercise pervasive control over the Primary Cooperative Societies and, therefore, the petitioners are entitled to regularization and consequential benefits under Rule 7(4) of the Rules. 4. (i) Learned counsel appearing for the respondents, ex adverso, submits that the writ petitions are wholly misconceived. It is submitted that the Federation is merely the Apex Body in a three-tier cooperative structure comprising the Federation, District Cooperative Unions and Primary Cooperative Societies. The Primary Cooperative Societies are independent cooperative bodies registered under the Chhattisgarh Cooperative Societies Act, 1960 (for short ‘the Act, 1960’). It is 31 WPS No.11180 of 2025 & other connected matters contended that the petitioners were appointed by their respective Primary Cooperative Societies against sanctioned posts of those societies and their appointment, disciplinary control, service conditions, removal and payment of salary are exclusively governed by the concerned Primary Cooperative Society. The Federation neither issued the appointment orders nor is it the appointing authority or employer of the petitioners. (ii) It is further submitted that Rule 7(4) of the Rules has been misconstrued by the petitioners. The said Rules merely provides that after successful completion of probation, an employee becomes a permanent employee of the concerned Primary Cooperative Society. The Rule neither creates any right of absorption in the Federation nor casts any obligation upon the Federation to regularize the services of the employees of the Primary Cooperative Societies or to grant them Government pay scales or other consequential service benefits. Learned counsel further submits that the Federation merely exercises supervisory and coordinating functions in respect of the cooperative structure and does not become the employer of the employees appointed by the Primary Cooperative Societies. It is also contended that the salaries of the petitioners are borne by the concerned Primary Cooperative Societies and not by the Federation or the State Government. It is lastly submitted that the appointing authority i.e. the concerned Primary Cooperative Society has not been impleaded as a 32 WPS No.11180 of 2025 & other connected matters party respondent and, therefore, in its absence no effective or enforceable direction can be issued by this Court. The writ petitions, therefore, deserve to be dismissed. 5. (A) In rejoinder, learned counsel for the petitioners reiterates the averments made in the writ petition and submits that the stand taken by the respondents is contrary to the documentary evidence placed on record. It is submitted that from the documents annexed with the petition read with the Rules of 2016, prima faice, demonstrate that the Federation exercises complete administrative, financial and functional control over the Primary Cooperative Societies. The Federation frames the service rules, controls appointments, finances the activities of the societies and supervises their functioning. (B) It is further submitted that the respondents have taken contradictory stands in their reply regarding the nature of control exercised by the Federation. According to the petitioners, there exists a direct employer-employee relationship between the Federation and the petitioners and, therefore, the Federation cannot avoid its liability by describing the Primary Cooperative Societies as independent bodies. The petitioners accordingly pray that the writ petitions be allowed. 6. I have heard learned counsel appearing for the parties and perused the pleadings and documents brought on record. 7. The principal contention of the petitioners is that though they are 33 WPS No.11180 of 2025 & other connected matters appointed as Managers in different Primary Forest Produce Cooperative Societies, they are, in fact, employees of the Federation and, therefore, upon successful completion of probation, they are entitled to regularization and consequential monetary benefits in terms of Rule 7(4) of the Rules. 8. Rule 2(iii) of the Rules defines the word "Prabandhak" in the following terms:- 2(iii) प्रबंधक" से तात्पर्य प्राथमिक वनोपज सहकारी संस्था के प्रबंधक से है। 9. The statutory definition itself leaves no room for ambiguity that the post of Manager is a post borne on the establishment of the Primary Forest Produce Cooperative Society and not of the Federation. Further, Rule 3(v) of the Rules specifically provides:- "3(v) अध्र्यक्ष, प्राथमिक वनोपज सहकारी समितित द्वारा प्रबंधक पद पर भत# के लि%र्ये संबंतिधत जिज%ा र्यूमिनर्यन को लि%लि(त आवेदन मिकर्या जार्येगा।" 10. The aforesaid Rule clearly demonstrates that the recruitment process originates from the concerned Primary Forest Produce Cooperative Society, whose President submits the requisition to the District Union for filling up the post. The recruitment procedure is thereafter governed by Rule 6, wherein Rule 6(v) specifically mandates:- "6(v) प्रबंधक की मिनर्युमि- का आदेश अध्र्यक्ष, प्राथमिक वनोपज सहकारी 34 WPS No.11180 of 2025 & other connected matters संस्था के हस्ताक्षर से जारी मिकर्या जार्येगा।" 11. Thus, the statutory Rules unequivocally confer the power of appointment upon the President of the concerned Primary Forest Produce Cooperative Society. No provision of the Rules authorizes the Federation to issue appointment orders or appoint Managers. Likewise, Rule 7(iv) provides:- "7(iv) चर्यमिनत अभ्र्यथ# एक वर्ष की अवतिध तक परिरवीक्षा पर कार्य रत रहेगा, तत्पश्चात उसे मिनर्यमित मिकर्या जार्येगा।" 12. The aforesaid provision merely provides for confirmation of a Manager after successful completion of probation in the service of the concerned Primary Cooperative Society. The Rule nowhere provides that such confirmation would result in absorption in the Federation or that the Federation becomes the employer of such Managers. The submission of the petitioners that Rule 7(4) creates a right of regularization against the Federation is, therefore, contrary to the plain language of the Rules themselves. 13. The documents relied upon by the parties also support the aforesaid statutory scheme. Annexure R-1 depicts the organizational structure of the three-tier cooperative system comprising the State Federation, District Unions and Primary Forest Produce Cooperative Societies. The said document itself shows that the Primary Cooperative Societies 35 WPS No.11180 of 2025 & other connected matters constitute the lowest independent tier of the cooperative structure. 14. Similarly, Annexure P/9, relied upon by the petitioners, also depicts the same three-tier structure. Merely because the Federation exercises supervisory, financial or administrative control over the District Unions and Primary Cooperative Societies would not ipso facto establish an employer-employee relationship between the Federation and the Managers appointed by the Primary Cooperative Societies. Further, Annexure P/10 specifically records that each Primary Forest Produce Cooperative Society has its own Board of Directors, separate area of jurisdiction and a part-time Manager appointed by the concerned Society. The said order dated 21.11.2017 (Annexure-P/10), therefore, rather than supporting the petitioners, reinforces the respondents' contention that the Managers belong to the respective Primary Cooperative Societies. The Court also finds considerable force in the submission advanced on behalf of the respondents that the petitioners have failed to establish the foundational facts necessary for issuance of a writ of mandamus. 15. It is also noteworthy to mention here that except one appointment order (page 18 of WPS No.11180 of 2025) placed on record, none of the petitioners has filed his appointment order, which has duly been issued by the competent authority. Consequently, this Court is unable to ascertain the appointing authority, the terms and conditions of 36 WPS No.11180 of 2025 & other connected matters appointment, the nature of employment or the authority under whose establishment the petitioners are serving. Even the solitary appointment order placed on record does not disclose that the appointment has been made by the Federation. On the contrary, the Rules clearly provide that the appointment order is to be issued under the signature of the President of the concerned Primary Forest Produce Cooperative Society. In absence of appointment orders of all the petitioners, this Court cannot presume that they were appointed by the Federation. Whereas one of the appointment order (Page 18 of WPS No.11180 of 2025) has been issued by the President of concerned Society only. 16. More importantly, the authority which is alleged to have appointed the petitioners has not even been impleaded as a party respondent. When the statutory Rules themselves provide that the appointment order is issued by the President of the concerned Primary Cooperative Society, no effective writ can be issued against the Federation in absence of the appointing authority. 17. It is the well settled propositions of law that no order can be passed behind the back of a person adversely affecting him and such an order, if passed, is liable to be ignored being not binding on such a party as the same has been passed in violation of the principles of natural justice. It is also the trite law that the litigant has to ensure that the 37 WPS No.11180 of 2025 & other connected matters necessary party is before the Court, be it a plaintiff or a defendant, otherwise the proceedings will have to fail. 18. The reliance placed by the petitioners upon the administrative control exercised by the Federation is also misconceived. Administrative supervision, financial assistance, policy formulation or regulatory control cannot by themselves determine the relationship of employer and employee when the governing statutory Rules expressly vest the powers of recruitment, appointment and confirmation in another statutory authority. 19. The provisions contained in Section 55 of the Act, 1960 also assume significance, which speaks about Registrar’s power to determine conditions of employment. The same reads thus : “55. Registrar's power to determine conditions of employment (1) The Registrar, may, from time to time, frame rules governing the terms and conditions of employment in a society or class of societies and the society or class of societies to which such terms and conditions of employment are applicable shall comply with the order that may be issued by the Registrar in this behalf : (2) Where a employment, working conditions and disciplinary action taken by a dispute, including a dispute regarding terms of society, arises between a society and its employees, the Registrar or any officer appointed by him not below the rank of Assistant Registrar shall decide the dispute and his decision shall be binding on the society and its employees: 38 WPS No.11180 of 2025 & other connected matters Provided that the Registrar or the officer referred to above shall not entertain the dispute unless presented to him within thirty days from the date of order sought to be impugned: Provided further that in computing the period of limitation under the foregoing proviso, the time requisite for obtaining copy of the order shall be excluded.” 20. The petitioners have not demonstrated that such statutory remedy either stood exhausted or was unavailable before invoking the extraordinary jurisdiction of this Court. It is a well-settled principle of law that when a remedy is available, writ jurisdiction under Article 226 of the Constitution should not ordinarily be exercised. 21. The Supreme Court in the matter of State of H.P. and Others v Gujarat Ambuja Cement Limited & Another reported in (2005) 6 SCC 499 held that normally the High Court should not interfere if there is an adequate efficacious alternate remedy. Further, the Supreme Court in Assistant Commissioner (CT) LTU, Kakinada v. Glaxo Smith Kline Consumer Health Care Ltd., (2020) 19 SCC 172, reiterated that writ jurisdiction should not be invoked when a statutory forum is available and has not been availed. 22. It is noteworthy to mention here that neither the statutory Rules nor the documents relied upon by the petitioners establish that the Federation is their employer. Rather, the cumulative effect of Rules and the documents placed before this Court unmistakably demonstrates that: 39 WPS No.11180 of 2025 & other connected matters (i) the post of Manager belongs to the concerned Primary Forest Produce Cooperative Society; (ii) recruitment is initiated by the President of the concerned Primary Society; (iii) appointment orders are issued by the President of the concerned Primary Society; (iv) confirmation after probation is only in the service of the concerned Primary Society; and (v) the Federation merely exercises supervisory and coordinating functions over the three-tier cooperative structure and does not become the employer of the Managers. 23. In view of the aforesaid discussion, the petitioners have failed to establish any statutory or legal obligation cast upon the Federation to regularize their services or grant them salary and consequential benefits as employees of the Federation. 24. In the result, all the writ petitions, being devoid of merit, are liable to be and are hereby dismissed. 25. However, liberty is reserved in favour of the petitioners to avail such remedy as may be available to them under the provisions of the law, if so advised. SD/- (Bibhu Datta Guru) JUDGE ashu
