This Letters Patent Appeal is directed against an interim Order dated 16th of April, 2022 passed by the learned Single Judge of this Court [“the Writ Court”] in WP (C) No. 749/2021 titled ‘M/S Hotel Reganta Central Point v. UT of J&K and Ors.’. 02. The impugned Order, on the face of it, is interim and is liable to be modified/ vacated on Objections and arguments by the Appellants herein/ Respondents before the Writ Court and, therefore, this appeal is not maintainable. 03. Faced with the aforesaid position, the learned Counsel appearing for the Appellants seeks leave of this Court to withdraw the instant appeal with liberty to the Appellants herein/ Respondents before the Writ Court to seek vacation/ modification of the interim Order before the Writ Court. The statement of the learned Counsel is taken on record. 04. In view of above, this appeal shall stand dismissed for want of prosecution, along with the connected CM(s)m with liberty to the Appellants herein, as aforesaid. Interim direction(s), if any subsisting as on date, shall stand vacated. 05. At this stage, the learned Counsel for the Appellants submits that since the pleadings in the matter before the Writ Court are complete, it would be in the fitness of things to request the Writ Court to expedite the hearing of the matter. 06. In view of the aforesaid prayer made by the learned Counsel appearing for the Appellants, we request the Writ Court to make an endeavor to finally decide the Petition filed by the Respondent herein, as expeditiously as possible.
