The case of the petitioner is as follows: 2. The petitioner is the legally wedded wife of the respondent anb their marriage has been performed at Palnadu District on 23.06.2022, as per Hindu rites and customs. In view of the matrimonial disputes bitween both the parties, the petitioner/wife along with a female child aged about 2 years are staying at her parents’ house at Nandyal Town and District and depending upon the mercy of her parents. The petitioner contend that to cause inconvenience to the petitioner, the respondent/hijisband filed F.C.O.P.No.101 of 2024, on the file of the Judge, Family Court, Vijayawada, under Section 9 of the Hindu Marriage Act, 1955, seeking for restitution of conjugal rights and the same is also pending for adjudication. I. II. The petitioner further contended that the petitioner being a Vvoman I having a female child aged about 2 years, depending upon the mercy of her parents, it is very difficult for her to travel at a distance of more than 350 Kms from Nandyal to Vijayawada without any male support and ' 2 that she was constrained to file the present petition against the .101 of 2024, and transfer the same to respondent/husband seeking to withdraw F.C.O.P.No the file of the Judge, Family Court, Vijayawada on I the Senior Civil Judge Court, Nandyal. 3. ! Heard Varun Byreddy, learned I Veerendranath Maddineni, learned counsel for the petitioner and Sri counsel for the respondent. Perused the material available on record. 4. Today when the matter is taken up for hearing, learned counsel for the respbndent had fairly represented that they have the |case in F.C.O.P.No. 101 of 2024 no objection in transferring from the Judge, Family Court, Vijayawada to the Senior Civil Judge Court, the present transfer civil miscellaneous Nandyal and represented to allow petition. 5. On considering the submissions respondent, without going into merits of the transfer made by the learned counsel for the civil miscellaneous present transfer civil miscellaneous Judge, the same to the Senior Civil Judge petiticj)n, this Court is inclined to allow the 1 petitic n by withdrawing the in F.C.O.P.No.101 of 2024, from the case Family Court, Vijayawada and transferring Court, Nandyal. In the result, the transfer civil 6. miscellaneous petition is allowed and the |n F.C.O.P.No.101 of 2024, Vijayawada, is hereby withdrawn and transferred case on the file of the Judge, Family Court, to the Senior Civil Judge Court, Nandyal. The learned Judge, Family Court the case record in F.C.O.P.No.101 of 2024 to the Senior , Vijayawada, shall transmit Civil Judge Court, 3 Nandyal, duly indexed as expeditiously as possible preferably within a period i of two (02) weeks from the date of receipt of a copy of the order. Ejoth the parties are directed to appear before the learned Senior Civil Judge Court, Nandyal, on 10.09.2025 at 10.30 a.m. There shall be no order as to costs.
