Mr. Parikshit Saini, Advocate for the petitioner. 2. This contempt petition has been filed alleging disobedience of order dated 03.12.2024. It is alleged that despite the direction issued by Writ Court, the competent authority has granted permission for advertising only five vacancies, whereas, there are seven more vacancies in the concerned institution. 3. Perusal of the order passed by Writ Court reveals that writ petition filed by petitioner was decided in terms of final order passed in WPMS No. 3405 of 2023. The said writ petition was disposed of in view of the statement made by In-charge Secretary, Department of Education that necessary directions have been issued to Director General, School Education to commence selection process. Paragraph no. 6 of the final order passed in WPMS No. 3405 of 2023 reveals that the recruitment process, if initiated, shall be subject to outcome of WPMS No. 2839 of 2023. 4. From reading of the final order passed in the said writ petition, it is revealed that there is no direction issued to the authorities to grant permission in respect of all vacancies available in a particular college. In the absence of any such positive direction, the competent authority has granted permission for advertising five vacancies, which is good enough. Thus, this Court finds that this is not a case of wilful disobedience in which contempt proceedings may be initiated. 5. Accordingly, contempt petition is dismissed.
