No reply is intended to be filed on behalf of the non- applicants/proposed LRs. Non-applicants/proposed LRs have no objection, if in case the present application is allowed and they are impleaded as party respondents, in the case at hand.
Sole respondent is stated to have died on
04.04.2018. The same is evident from the death certificate appended along with the present application. The details of legal heirs are given in para 4 of the application. The right to sue survives in the said legal heirs of deceased sole respondent.
For the reasons mentioned in the application, delay in bringing on record the LRs of deceased sole respondent is condoned, abatement, if any is set aside. The proposed legal heirs of deceased sole respondent are ordered to be brought on record.
Amended memo of parties filed along with the application, is ordered to be taken on record, if in order. Power of Attorney on their behalf stands filed. Application stands disposed of.
