Order 20/03/2025
1. The instant bail applications have been filed under Section 483 of BNSS on behalf of the petitioners, who have been arrested
[2025:RJ-JP:12728] (2 of 4) [CRLMB-3007/2025] in connection with FIR No.254/2024 registered at Police Station Rupangarh, District Ajmer (Rajasthan) for the offences punishable under Sections 115(2), 126(2), 140(3), 308(2), 308(4) & 304(2) of the Bharatiya Nyaya Sanhita, (in short ‘BNS’) 2023. Later on, police filed charge-sheet in these matters for the offences punishable under Sections 115(2), 126(2), 140(3) & 310(2) of BNS, 2023.
2. The first bail applications of the petitioners were dismissed was withdrawn vide order dated 23.01.2025 with liberty to renew the prayer of bail after submission of result of investigation. Now, charge-sheet has been filed thus, these second bail applications have been preferred on behalf of the petitioners.
3. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated. It is submitted that facts have been exaggerated in the FIR. It is submitted that though test identification parade has been conducted in this matter and petitioners have been identified by the complainant but it does not hold any value as when petitioners were arrested their face was not covered. It is contended that charge-sheet has been filed and trial will take considerable time in its conclusion. Petitioners are in custody since 27.12.2024 and further custody of the petitioners would not serve any fruitful purpose.
4. Learned Public Prosecutor assisted by counsel for the complainant opposes the submissions made by counsel for the petitioners. It is submitted that some currency notes have been recovered at the instance of the petitioners.
[2025:RJ-JP:12728] (3 of 4) [CRLMB-3007/2025]
5. I have considered the contentions.
6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioners, as also considering the material made available in the form of charge-sheet and trial will take considerable time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow these bail applications.
7. These bail applications are accordingly allowed and it is
directed that accused-petitioners 1) Kishan S/o Kalluram, 2) Hansraj Jevaliya S/o Shri Ratanlal, 3) Ramesh Jat S/o Jairam, 4) Jitendra Bajdoliya S/o Nathuram and 5) Vijay S/o Jeevanram, shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
8. It is made clear that the accused-petitioners shall not involve in any other offence(s) during currency of the bail and they shall mark their presence in second week of every month in the concerned police station.
9. If any breach of these conditions is reported or come to the
[2025:RJ-JP:12728] (4 of 4) [CRLMB-3007/2025] notice of the Court, the same shall alone be a reason for the trial court to cancel the bail granted to them by this Court.
10. Concerned S.H.O. is directed to maintain a register recording the attendance of the petitioners. In case the petitioners fail to mark their presence in the concerned police station, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.
